MOTORCYCLE RENTAL CONTRACT
DEVOLUCIÓN | RETURN
ES: El ARRENDATARIO deberá devolver la motocicleta en la fecha y hora indicadas, en las mismas condiciones, salvo el desgaste normal. Las devoluciones tardías generan cargos adicionales. Las devoluciones anticipadas no dan derecho a reembolso. La no devolución en el plazo acordado podrá dar lugar a denuncia policial, salvo que el ARRENDATARIO contacte a la oficina antes de la fecha límite. Operar la motocicleta con un contrato vencido cancela el seguro.
EN: The LESSEE must return the motorcycle on the date and time indicated, in the same condition except for normal wear. Late returns incur additional charges. Early returns do not entitle the LESSEE to a refund. Failure to return the motorcycle within the agreed period may result in a police report unless the LESSEE contacts the office before the deadline. Operating the motorcycle with an expired contract voids the insurance.
GARANTÍAS MECÁNICAS | MECHANICAL GUARANTEES
ES: Las fallas mecánicas fuera del control del ARRENDADOR darán lugar al reembolso de los días de alquiler no utilizados. El ARRENDADOR podrá sustituir la motocicleta, cobrando al ARRENDATARIO cualquier diferencia de modelo. El ARRENDATARIO renuncia a futuras reclamaciones. El ARRENDATARIO deberá obtener autorización escrita antes de incurrir en cualquier costo de reparación.
EN: Mechanical failures beyond the control of the LESSOR will result in reimbursement of unused rental days. The LESSOR may replace the motorcycle and charge the LESSEE for any model difference. The LESSEE waives future claims. The LESSEE must obtain written authorization before incurring any repair costs.
CONDICIONES DEL CONDUCTOR | DRIVER REQUIREMENTS
ES: El ARRENDATARIO y todo conductor autorizado afirman cumplir con los requisitos de edad y experiencia, y poseer licencia válida para motocicleta en Costa Rica. Se comprometen a no operar la motocicleta bajo la influencia de sustancias que afecten su capacidad para conducir. Si el ARRENDATARIO es extranjero, deberá presentar una licencia vigente y su pasaporte válido por hasta tres meses después de su último ingreso al país.
EN: The LESSEE and any authorized driver affirm that they meet the age and experience requirements and possess a valid motorcycle license in Costa Rica. They agree not to operate the motorcycle under the influence of substances that impair driving ability. If the LESSEE is a foreigner, he must present a valid driver’s license and a passport valid for up to three months after his last entry into the country.
PRÉSTAMO DE LA MOTOCICLETA | LOAN OF THE MOTORCYCLE
ES: El ARRENDATARIO no podrá prestar la motocicleta sin el consentimiento previo del ARRENDADOR. El ARRENDATARIO sigue siendo el único responsable de los daños ocasionados durante dicho préstamo.
EN: The LESSEE may not lend the motorcycle without prior consent of the LESSOR. The LESSEE remains solely responsible for any damages occurring during such loan.
RESTRICCIONES DE USO | RESTRICTIONS OF USE
ES: El ARRENDATARIO acepta las siguientes pautas y restricciones operativas:
EN: The LESSEE agrees to the following operational guidelines and restrictions:
- ES: No operar la motocicleta ni permitir que sea operada para transportar pasajeros o mercancías adicionales si esto implica subarrendar el vehículo.
EN: Do not operate or allow the motorcycle to be used to transport additional passengers or goods if this implies subletting the vehicle.
- ES: No permitir que la motocicleta sea conducida por persona no autorizada en el contrato.
EN: Do not allow the motorcycle to be driven by anyone not authorized in the contract.
- ES: No conducir en malas condiciones físicas o bajo efectos de alcohol o drogas.
EN: Do not drive in poor physical condition or under the influence of alcohol or drugs.
- ES: No usar la motocicleta para empujar o remolcar otro vehículo.
EN: Do not use the motorcycle to push or tow another vehicle.
- ES: No operar la motocicleta en carreras, pruebas o competencias, oficiales o no.
EN: Do not operate the motorcycle in races, tests, or competitions, official or otherwise.
- ES: No intervenir, modificar, manipular, reparar o sustituir piezas sin autorización escrita.
EN: Do not modify, manipulate, repair, or replace any parts without written authorization.
- ES: No conducir fuera de las zonas establecidas en la cláusula 8.
EN: Do not drive outside the circulation areas defined in Clause 8.
- ES: No transportar sustancias peligrosas, explosivas o mercancías que excedan los límites autorizados.
EN: Do not transport hazardous, explosive substances or goods exceeding authorized limits.
- ES: No conducir por caminos no mantenidos, playas o superficies que puedan dañar la motocicleta.
EN: Do not drive on unmaintained roads, beaches, or surfaces that may damage the motorcycle.
- ES: No conducir dentro de puertos o aeropuertos.
EN: Do not drive within port or airport operational zones.
- ES: Estacionar el vehículo en lugares adecuados y seguros.
EN: Park the vehicle in appropriate and safe areas.
- ES: Monitorear niveles de aceite, fluidos y presión de llantas y detenerse si se enciende alguna luz de advertencia; contactar al ARRENDADOR de inmediato.
EN: Monitor oil, fluids, and tire pressure and stop immediately if any warning light appears; contact the LESSOR immediately.
- ES: Usar únicamente gasolina sin plomo. La carga de diésel causa daños graves y será responsabilidad del ARRENDATARIO, además de tres días de alquiler por lucro cesante (mínimo $50/día).
EN: Use unleaded gasoline only. Diesel causes serious damage and will be charged to the LESSEE, plus three days of rental for loss of use (minimum $50/day).
INCUMPLIMIENTO | BREACH
ES: El incumplimiento de cualquier requisito anula el contrato y hará responsable al ARRENDATARIO por multas, costos o daños, manteniendo indemne al ARRENDADOR.
EN: Breach of any requirement voids the contract and makes the LESSEE responsible for fines, costs, or damages, holding the LESSOR harmless.
MAL USO | MISUSE
ES: El mal uso, incluyendo desgaste anormal, será responsabilidad del ARRENDATARIO.
EN: Misuse, including abnormal wear, will be the responsibility of the LESSEE.
ZONAS DE CIRCULACIÓN | CIRCULATION AREAS
ES: No se permite conducir fuera de Costa Rica.
EN: Driving outside Costa Rica is prohibited.
ACCIDENTES | ACCIDENTS
ES: El ARRENDATARIO deberá informar inmediatamente cualquier accidente, cooperar con las autoridades y seguir los procedimientos indicados. No podrá reparar la motocicleta por su cuenta. El ARRENDADOR podrá retener el depósito hasta que se resuelvan los daños.
EN: The LESSEE must immediately report any accident, cooperate with authorities, and follow specified procedures. The LESSEE may not repair the motorcycle on his own. The LESSOR may retain the deposit until damages are resolved.
DEPÓSITO DE SEGURIDAD | SECURITY DEPOSIT
ES: El ARRENDATARIO deberá entregar un depósito de US$500 mediante tarjeta de crédito, utilizado para daños, faltantes, multas o cualquier obligación contractual.
EN: The LESSEE must provide a US$500 credit-card deposit, used for damages, missing parts, fines, or any contractual obligations.
DAÑOS A LA MOTOCICLETA | DAMAGE TO THE MOTORCYCLE
ES: El ARRENDATARIO es responsable por todos los daños durante el período de alquiler. Daños por agua generan un cargo automático de US$2,000.
EN: The LESSEE is responsible for all damage during the rental period. Water damage results in an automatic US$2,000 charge.
PÉRDIDA O ROBO | LOSS OR THEFT
ES: El ARRENDATARIO deberá notificar inmediatamente al ARRENDADOR en caso de robo o pérdida total. La negligencia genera responsabilidad total por el valor de mercado.
EN: The LESSEE must immediately notify the LESSOR in case of theft or total loss. Negligence results in full liability for market value.
LESIONES Y DAÑOS | INJURIES AND PROPERTY DAMAGE
ES: El ARRENDATARIO exonera al ARRENDADOR por lesiones o daños derivados del uso de la motocicleta.
EN: The LESSEE releases the LESSOR from liability for injuries or damages related to motorcycle use.
COMBUSTIBLE | FUEL
ES: La motocicleta debe devolverse con el tanque lleno. De lo contrario, se aplicarán cargos adicionales.
EN: The motorcycle must be returned with a full tank. Otherwise, additional charges apply.
MULTAS Y CARGOS | FINES AND CHARGES
ES: El ARRENDATARIO deberá pagar todas las multas y cargos por incumplimiento de leyes o retiro de la motocicleta por parte de autoridades.
EN: The LESSEE must pay all fines and charges related to legal violations or removal of the motorcycle by authorities.
SEGURO | INSURANCE
ES: El ARRENDADOR proporciona seguro básico. Ciertos costos quedan a cargo del ARRENDATARIO.
EN: The LESSOR provides basic insurance. Certain costs are the responsibility of the LESSEE.
PÉRDIDA DE LLAVES Y EQUIPO | LOSS OF KEYS AND EQUIPMENT
ES: Los costos por pérdida se deducen del depósito; si es insuficiente, se cargará a la tarjeta.
EN: Costs for lost items are deducted from the deposit; if insufficient, they will be charged to the credit card.
RESERVAS | RESERVATIONS
ES: Las reservas se pueden realizar por teléfono o correo electrónico. Reembolsos dependen del período de aviso previo.
EN: Reservations may be made by phone or email. Refunds depend on the notice period.
RECONOCIMIENTO | RENTAL ACKNOWLEDGMENT
ES: El ARRENDATARIO reconoce haber leído e incluido este contrato.
EN: The LESSEE acknowledges having read and accepted this contract.
JURISDICCIÓN | JURISDICTION
ES: Ambas partes se someten a los tribunales de Costa Rica.
EN: Both parties submit to the courts of Costa Rica.
